Land and infrastructure development projects are not without pitfalls and challenges - often resulting in disputes between parties.


Disputes regarding property boundaries, access roads and even development rights have resulted in many owners approaching the courts for clarification and a ruling - at a great expense.


Mediation is a voluntary, cost effective, flexible and confidential way of resolving disputes whereby a trained mediator facilitates between the parties in an impartial and professional manner to negotiate a settlement.


The Department of Justice & Constitutional Development have introduced court-annexed mediation in an effort to relieve the pressure on the courts.  The process was initially rolled-out in certain magistrates' courts in the Gauteng and North West provinces and other provinces are to follow.


Parties may request that a dispute be referred to mediation prior to litigation, or after commencement of litigation, but before judgement. However, a court may also (prior or during a trial) refer a dispute for mediation.
